All content, features, and functionality of the Services, including but not limited to software, algorithms, and documentation, are owned by YANAYA HEALTHCARE or its licensors and are protected by copyright and other intellectual property laws.

5. Limitation of Liability

To the extent permitted by law, YANAYA HEALTHCARE shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of revenue, profits, or data
• Clinical outcomes or patient health decisions
• Third-party services or integrations

Our total liability shall not exceed the amount paid for Services in the 12 months preceding the claim.

6. Disclaimer of Warranties

The Services are provided "as-is" and "as-available" without warranties of any kind, express or implied. YANAYA HEALTHCARE does not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements.

7. Indemnification

You agree to indemnify and hold harmless YANAYA HEALTHCARE from any claims, damages, or costs arising from your use of the Services, violation of these terms, or infringement of third-party rights.

8. Termination

YANAYA HEALTHCARE may terminate your account if you violate these terms, breach regulatory requirements, or engage in unauthorized use. Upon termination, your access will be immediately revoked.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of California, USA, without regard to its conflict of law principles. Any disputes shall be subject to exclusive jurisdiction of California courts.

YANAYA HEALTHCARE is fully compliant with the Health Insurance Portability and Accountability Act (HIPAA) of 1996 and its Privacy, Security, and Breach Notification Rules. We maintain Business Associate Agreements (BAAs) with all covered entities and business associates.

4. Business Associate Agreements

All vendors, subcontractors, and business associates sign Business Associate Agreements (BAAs) that obligate them to comply with HIPAA requirements. We maintain a comprehensive BAA register and regularly audit compliance.

For research and analytics purposes, we comply with HIPAA de-identification standards by removing 18 categories of identifiers. De-identified data may be used for machine learning model training, population health analysis, and academic research.
